Epcy Limited’s Terms and Conditions For Users and Visitors

Epcy Limited (Epcy) is a technology company based at 17 Green Lanes, London, N16 9BS United Kingdom.

User is the person who registers on Epcy to use and consume its services.

Registration means that User willingly enters personal information required, creates password and username on Epcy databases in or out of the U.K.

Visitor is someone who uses and consumes Epcy services without registering, but provides personal information through other means on Epcy.com. Visitor can sometimes be used interchangeably with User. They refer to the same person.

Clinic is a healthcare institution that provides healthcare services to Users and Visitors through Epcy.

Hospital is a healthcare institution that provides healthcare services to Users and Visitors through Epcy.

Clinic and Hospital provide the same or similar services, and could be sometimes used interchangeably in this document.

Epcy.com (“www.epcy.com and “epcy.com”) is Epcy’s website domain address where Epcy offers some of its services to Users and Visitors.

Website is a list of domain names such as but not limited to epcy.com or www.epcy.com, epcy.co.uk, operated by Epcy Limited.

Epcy.com and Website mean the same in this document.

Referral by Epcy means that Epcy initiates a communication for a Visitor’s or User’s intent to get treatment or consultation from a Clinic or Hospital. This communication can be in any form or shape of communication whether it is verbal, or written, in person or by means of electronic devices or telephone systems. It can also be established through Epcy’s Website, Epcy’s Services, Instant messaging applications such as WhatsApp but not limited to it, or social media platforms such as Instagram or Tik Tok or similar applications. Once Visitor’s intent to get a treatment from Clinic or Hospital is communicated to the Clinic, it means that Referral by Epcy has been established and completed.

Referral by Visitor means that new Visitors provide Epcy with the first and last name of the Visitor who referred them to use Epcy services.

Service Fee refers to a specified percentage of the service fee by the User or Visitor for the Service received from the Clinic or Hospital through Referral by Epcy, and it is payable by the Clinic to Epcy Limited.

Clinic Data means all data, works and materials: (i) uploaded to or stored on the Website by Clinic; (ii) transferred from the Website at Clinic’s instigation; (iii) supplied by Clinic to Epcy for uploading to the Website; (iv) generated by the Website as a result of use of the Services (but excluding analytics data relating to use of the Website and server log files).

Content means any text, graphic, image, sound, video, software, data compilation or other form of information that may be stored on a computer and that appears on or is part of this Website and the Application.

These Terms and Conditions govern your access to and use of Epcy’s website, Epcy services and mobile applications, (collectively, the “Website”) and the services offered by Epcy (the “Services”), which are owned and operated by Epcy Limited.

Please read these Terms of Use carefully before using or registering for the Site and Services. These Terms of Use constitute a legally binding agreement between you as the website Users, Visitor and Epcy. We object to the applicability of any conflicting terms and conditions.

We may make changes to these terms and conditions from time to time without notice. Please review these terms and conditions each time you use our website or services to ensure that you understand the then-current terms and conditions governing your use of our website. Your continued use of our website after we have made any changes to these terms and conditions will constitute your acceptance of any changes and your agreement to these terms and conditions.

We may update or modify our websites or portions thereof from time to time to reflect changes in our products and/or services, the needs of our users, and/or our business requirements.

1. Services

These Terms and Conditions for Users and Visitors govern Users’ and Visitor’ access to and use of Epcy’s website and mobile applications (www.epcy.com and other Epcy websites with different domain extensions such as epcy.co.uk and epcy.de), but managed by Epcy (collectively, the “Website“) and the services (the “Services” offered on the Website, and instant messaging platforms such as but not limited to WhatsApp, social media applications such as but not limited to Instagram, Facebook, and Tik Tok.

Epcy’s services consist of publishing information about doctors, hospitals and clinics for Visitors and Users via its website epcy.com and other Epcy websites with different domain extensions (such as epcy.co.uk and epcy.de), but managed by Epcy.

Epcy services include getting estimates on behalf of User and Visitor for medical treatments from multiple clinics based on personal health data provided by User and Visitor. By providing this data, User and Visitor agree that Epcy can share them with any Clinic at its disposal solely for the purpose of obtaining estimates on behalf of Users and Visitors.

By using Epcy services Users and Visitors give Epcy full permission to contact them via instant messaging and social media applications such as WhatsApp, Instagram and similar applications. Users and Visitors agree to give full permission to send their medical records, data and information through these applications.

By using Epcy services Users and Visitors give Epcy full permission to share their medical records, data and information with Clinics and Hospitals via instant messaging and social media applications such as WhatsApp, Instagram and similar applications. Users and Visitors agree to give full permission to Epcy to share their medical records, data and information through these applications with any Clinic and Hospital at Epcy’s disposal.

Users and Visitors agree not to hold Epcy responsible and liable for any misuse of this information and data by the Clinic. It’s the Clinic’s responsibility to use and keep the data and information for estimating and quoting of the treatment for User and Visitor. User and Visitor agrees to indemnify Epcy and its directors, shareholders, employees, partners, companies from any misuse of their personal data by the Clinics that Epcy shares their personal data for estimating and quoting purposes.

Visitors and Users, if they wish, can contact these clinics and hospitals directly through Epcy.com (email, Whatsapp, social media accounts, phone, etc.).

2. Correctness of the data

Epcy Limited, through its website epcy.com, provides services such as listing individuals and organizations that provide healthcare services. Epcy allows Users and Visitors to search and contact Clinics and Hospitals based on various criteria on data available Clinics’ and Hospitals’ profile . In addition to these services, Epcy collects user’s medical records and personal data using backend services and third party applications and forms in order to share them with Clinics that provide estimates and quotes to Visitors and Users via Epcy. Clinics must have this data and information in order to accurately provide estimates and quotes to Visitors and Users.

Visitor and User agrees to allow Epcy to share Visitor’s personal data including but not limited to photos, medical records, personal identifiers, with Clinics for the purpose of estimating and treatment planning.

Epcy shall not be liable in any manner whatsoever for any Content, including, without limitation, for any errors or negligence in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Website and the Services. Any use of Content or materials posted or obtained through the Website and Services is at the Visitor’s or User’s own risk. The Visitor and User acknowledges and agrees that sole responsibility for any postings, messages, text, files, images, photos, videos, audio files or other content posted on, transmitted through or linked to the Website and the Services rests with the person or entity from whom such content originated.

Epcy acts as a search engine and referral platform for healthcare facilities and Visitors and Users seeking treatment estimates from these Clinics. Epcy does not act as an agent or Clinic for or on behalf of Users, and Visitors. You should always seek the advice of a physician or professional for specific health advice. Epcy does not provide health advice to Users, Visitors, and Clinics.

Epcy cannot be held liable for the services of third parties or their agents or Clinics. Epcy cannot assume any responsibility or liability for the timeliness, completeness or accuracy of the content and derivatives provided to you through the Site or Services. You understand and agree that Epcy does not enter into any fiduciary or agency relationship with you solely as a result of your use of the Site or Services or your access to any materials available on the Site.

Epcy reserves the right, in its sole discretion, to make changes to the operation of the Service from time to time without notice. A description of how the Service will operate should not be construed as a representation or commitment as to how the Service will always operate.

3. Fees

Currently using Epcy and its services are free for Visitors and Users. If there is a change in this policy, we will update our terms and conditions which will reflect those changes.

Epcy Limited reserves the right to change or update the details of its fees at any time without any advance notice to the Visitor and User. You will be notified at the time of using our service or you may check terms and conditions regularly to find out any updates.

4. Complication Insurance

Healthcare Tourism Complication Insurance provides coverage for foreign individuals who are planning to have one of the specified surgeries or treatments in Turkey. Coverage becomes valid in case of repetition of the same surgery due to complications that should arise after the primary surgery. Both the primary surgery and the repetition surgery should be undertaken in Turkey. The policy is valid for 6 months starting from the date of commencement.

Visitors and Users may get a bonus in the same amount of Complication Insurance cost if they do all of the following at the same time:

buy their insurance through Epcy’s partner insurance agency or broker
buy their treatment from one of the Clinics referred by Epcy through Referral by Epcy
pay the treatment cost in full to the Clinic
provide Epcy with the treatment invoice and receipts given by Clinic
to be eligible for a reimbursement for the cost of complication insurance, the treatment amount that visitor pay must be minimum £4500 GBP or in equivalent currency.
The eligibility for the reimbursement of the complication insurance cost may vary by each offer.
Eligibility is not always guaranteed and it is determined solely at Epcy Limited’s discretion for each Visitor.
Visitor will be notified at the time of or before their purchase of treatment if they are eligible for the reimbursement of the cost of complication insurance.

The payment will be made to the bank account in the UK, the US, and EU. Epcy Limited currently cannot transfer payments to bank accounts outside of these countries.

All claims must be made within 20 business days for each payment Visitor makes to the Clinic. Any claim made beyond this period will not be fulfilled and insurance bonus will not be paid. Visitor and User who doesn’t make their bonus claims within 20 business days agrees to give up all their rights and claims from such bonus.

Epcy Limited reserves the right to change or update the details of this policy at any time without any advance notice to the Visitor and User. You will be notified at the time of using our service or you may check terms and conditions regularly to find out any updates.

5. Credits for Referral by Visitors

Epcy gives you 100 GBP in the form of future credit if a new Visitor mentions another Visitor’s full name and buys treatment from one of the clinics through Epcy services. The purchase must be initiated through Epcy’s service, not directly from the clinic.

Visitors who earn credits can only use their credits if they use Epcy’s services to get a new treatment.

Maximum amount of credit a Visitor can earn and accumulate in its life is 1000 GBP.

All credits must be spent within 365 days. Any claim made beyond this period will not be fulfilled and credit will be lost. Visitor and User who doesn’t make claims within 365 business days agrees to give up all their rights and claims from such credits.

6. Contact by Epcy

Visitor and User agrees to allow Epcy to contact them before, during, and after Visitor’s treatment for service satisfaction and marketing purposes.

7. Disclaimer of warranty and limitation of liability

7.1.Visitor and User expressly acknowledge that their use of the Website, and Epcy’s Services as it is and is made available, is within the scope of applicable laws and with all consequences. Epcy expressly disclaims all warranties, representations and conditions of any kind, express or implied, including, but not limited to, implied warranties or conditions of merchantability, fitness for a particular purpose and non-infringement arising out of your use of the Website. Your use of the Website is at your own discretion and risk.

7.2 Epcy does not warrant the accuracy, adequacy or completeness of any information or materials contained on or provided or received in connection with the Website, including, without limitation, information contained in any background or audit reports, whether commissioned by a Vendor or by Epcy. Epcy does not warrant that your use of the Site or the Services or the information on the Site will be secure, uninterrupted, error-free, available or accurate or that any errors on the Site will be corrected. We will endeavor to avoid limitations, disruptions, interruptions or other restrictions on your use of the Services to the extent technically possible. Please note that, given the current state of communications technology, we cannot completely exclude the possibility of such restrictions. This applies to content and transmission paths that are beyond our control.

7.3 The maintenance and further development of our services may lead to temporary restrictions in use. We will make every effort to keep these within reasonable limits for you.

7.4 To protect our systems as well as third parties from harmful programs and content such as viruses, Trojans or spam emails, we may use technical protection measures. This also includes the use of filter systems, insofar as this is appropriate in particular for the protection of telecommunications and data processing systems.

7.5 In no event shall Epcy be liable for any damages, whether direct, indirect, general, special, compensatory, consequential and/or incidental, arising out of the conduct of the Clinic or any other person in connection with the use of the Site or the Services, including, without limitation, personal injury (ii) your reliance on any information or other content posted on the Site or transmitted to or by any user of the Site or the Services, and (iii) any reviews or comments made about you by other users on the Site.

7.6 Visitor and User agrees that Epcy will not be liable for (i) indirect, special, incidental or consequential damages, (ii) lost profits, (iii) business interruption, (iv) loss of or damage to reputation, or (iv) loss of information or data.

7.7 As a Visitor or User, you agree that Epcy shall not be responsible or liable for any loss or damage of any kind incurred as a result of your dealings with Clinics on or off Epcy or the Services or with any third parties that access the Clinics through the Services. In the event that a dispute arises between participants on this Website or Epcy Services or between Clinics, Visitor (Users) and third parties, you understand and agree that Epcy has no obligation to become involved. In the event that you have a dispute with one or more other users, you hereby release Epcy, its officers, directors, shareholders, employees, agents and assigns from all claims, demands and damages (actual and consequential) of every kind, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or in any way connected with such disputes and/or our Service.

8. indemnification from damages

8.1. Visitor and User agrees to indemnify, defend and hold Epcy harmless from and against any and all claims regarding treatment(s) or implant(s) performed by Clinics. You agree not to file any claim(s) in court or with an attorney against Epcy Limited, its shareholders, its directors, employees, its partners in the event of any and all mistreatment, any and all claims, physical and mental damages, financial and physical losses, expenses, demands or liabilities, including attorneys’ fees and costs

8.2 Visitor and User agrees to indemnify, defend and hold Epcy harmless from and against any and all claims, physical and mental damages, financial and physical losses, expenses, demands or liabilities, including attorneys’ fees and costs, incurred by using Epcy’s Services in connection with any third party claim (including intellectual property claims) arising out of (i) your use, misuse or inability to, use the Site or Services, (iii) your violation of these Terms of Use or infringement of any third party rights, (iv) your interaction with or conduct toward other users, (v) your violation of any applicable law, rule or regulation, or (vi) information contained in any background or verification report, whether commissioned by a user or by Epcy. You agree to reasonably cooperate with Epcy in the defense of any such claim. Epcy reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by User.

8.3 Visitor and User agrees to indemnify, defend and hold Epcy harmless from and against any and all claims regarding treatment(s) or implant(s) performed by Clinics. You agree not to file any claim(s) in court or with an attorney against Epcy Limited, its shareholders, its directors, employees, its partners in the event of any and all mistreatment, any and all claims, physical and mental damages, financial and physical losses, expenses, demands or liabilities, including attorneys’ fees and costs

8.4 The Visitor and User agrees to receive commercial electronic messages with campaign, promotional and advertising content to your contact details and to process and share your personal data with our suppliers for this purpose.

8.5 As a Visitor or User, you assume all risks associated with the use of the Website and Services, including but not limited to all risks associated with online or offline interactions with Clinics, and others.

8.6 When you access the Website and/or use the Services or Additional Services, it is possible that Epcy will process your Personal Data. Visitor agrees and acknowledges that any data (e.g., details of orders completed, graphics, photos, reports generated, contact information) obtained through use of the Website, including Personal Data, may be transferred to another country for storage and service improvement purposes. 8.7 The Visitor and User undertakes to report any violation of the terms and conditions or any alleged misconduct by Clinics by e-mail to info@epcy.com.

When you access the Website and/or use the Services or Additional Services, it is possible that Epcy will process your Personal Data. Clinic agrees and acknowledges that any data (e.g., details of orders completed, reports generated, contact information) obtained through use of the Website, including Personal Data, may be transferred to another country for storage and service improvement purposes. To the extent this website contains links to other Internet sites, Epcy has no knowledge of or control over the information contained on such other sites and has not verified the accuracy of any information presented on such sites. Accordingly, Epcy assumes no responsibility for the information presented on such sites.

Our website may not be embedded in another website.

10. Non-confidentiality

Any communication or material you transmit to Epcy through the Epcy website or as electronic mail over the Internet, through instant messaging applications such as WhatsApp and others, social media platforms such as Instagram , Tik Tok, Facebook and similar ones, is submitted by Users and Visitors on a non-confidential basis. By sending Epcy any information or materials, you grant Epcy an unrestricted, irrevocable license to use, reproduce, display, perform, modify, transmit and distribute those materials or information, and you also agree that Epcy is free to use any ideas, concepts, know-how or techniques that you send Epcy for any purpose whatsoever. However, Epcy will not release Visitor’s or User’s name or otherwise publicize the fact that Visitor or User submitted the materials or other information to us unless (a) we have asked for your permission to use your name, or (b) we have given you advance notice that the materials or other information you submit to a particular part of this Site will be published with your name on it or otherwise used in connection with your name, or (c) we are required to do so by law.

11. No responsibility for viruses and you must not introduce them

We do not warrant that our website or any information you download from our website is secure or free of errors or viruses of any kind.

It is your sole responsibility to configure your information technology, computer programs and platform to access our website. You should use your own antivirus program.

You are prohibited from abusing our website by introducing viruses, Trojan horses, worms, logic bombs or other malicious or technologically harmful material. You are prohibited from attempting to gain unauthorized access to our website, the server on which our website is stored, or any server, computer or database connected to our website. 12.1 Submitting Reviews

Epcy’s review service is intended to enable Visitors and Clinics to benefit from the collection and sharing of Reviews for their mutual education and enhancement of the Clinic’s product and service offerings, and a Visitor’s purchasing decisions. In providing this service, Epcy acts as a trusted third party to, on the one hand, collect and disseminate Reviews related to a Visitor experience, and on the other hand, ensure the compliance of the collected content in the Review with applicable law in order to publish, reject or delete such Reviews. We call this our “Moderation” process about which you may find more details below in The Moderation Process.

You, as a Visitor, are given the opportunity to provide an honest Review regarding an actual experience you have had in purchasing a product or service to benefit from a Clinic. Accordingly, in order to provide any Review, you must comply with the Review Requirements and satisfy the following criteria:

You must be a natural person;
You must not have any personal interest that represents a conflict of interest with the Clinic for which you provide a Review;
Your Review must be based upon your personal experience in purchasing a product or service from the Clinic;
You must provide valid and current contact information to enable us to communicate with you, which we will manage according to our Privacy Policy; and
You guarantee the truthfulness of your Review.

When you submit any Review, you give us permission to contact you using any of the contact information either you or our Clinic has provided to us. We may contact you to verify information relating to your Review or your identity in order to attempt to validate your Review. You also acknowledge and agree that any Review submitted by you may be used without any compensation or other recognition to you, and may be published by Clinics and third parties as they wish.

We reserve the right to establish time periods during which we will accept any Review, including the amount of time after which any purchase of a product or service has been completed and the time a Review may be submitted. We prefer to obtain Reviews that are promptly provided but understand that sometimes a reason for submitting a Review may not be immediately apparent. We also recognize that circumstances or opinions may change, and so we may enable you to modify a Review within a limited time after you originally submit such Review. We will use our discretion in establishing time frames that serve the objectives of our Service and provide value to Visitor and Clinics.

12.3 Publishing Reviews

Epcy will determine whether a Review of their product or service will be publicly available, and the nature of communications with the Visitor of their product or service that may be accessed, communicated, and published using the Service. Epcy will also determine whether to enable the display of aggregate ratings and links for Reviews on third-party search engines and other services with which Epcy has a business relationship.

12.4 Review Requirements

If you desire to submit a Review, we require that you comply with the following requirements which are intended to promote a beneficial experience for all users of the Service:

Do not submit any Review or otherwise communicate using the Service in a manner that may constitute harassment or other inappropriate action towards another person or any organization.
Do not impersonate another person, including a Visitor or representative of any organization.
Do not upload any content that promotes any commercial product or otherwise solicit others to take any action, activity, or boycott, or join or become members of any other activity or organization.
Do not violate laws or regulations applicable to you or the use of the Service. You are responsible for complying with any laws or regulations applicable to your submission of a Review, including any information you provide and the content of your Review. You agree not to submit any Review or other information via the Service that violates any intellectual property rights or any other kind of privacy or publicity right of another person, or take any action that constitutes a criminal offense.
Do not upload, promote, or distribute software viruses or any other kind of computer code, files or programs that attempt to interrupt, destroy, limit, or interrupt the functionality of any computer software or hardware or telecommunications equipment.
Do not interfere with our servers or third party services utilized in providing or otherwise connected to the Service.
Do not attempt to probe, scan, or test the vulnerability of any of our Service or computer systems or breach any security or authentication measures.
Do not avoid, bypass, remove, deactivate, impair, descramble, or otherwise circumvent any technological measure implemented by us or any of our service providers or any other third party to protect the Service, the Reviews or any Clinic or Visitor information.
Do not encourage or enable any other individual or organization to do any of the foregoing.
Do not mention any doctor’s name or medical staff name.

We include these requirements because Epcy does not monitor all communications and activities that take place through the Service by Clinics or other Visitors, so we strive to provide guidance for appropriate conduct. Despite our efforts, we regret that there is a possibility you may be exposed to offensive, indecent, or objectionable behavior by other users of the Service; you understand this and, accordingly, agree that your use of the Service in this regard is at your own risk. If you do encounter any behavior that conflicts with these Review Requirements, or are subject to any other objectionable content, you may contact us at info@epcy.com.

12.5 Ownership of the Service

Epcy and its licensors exclusively own all rights, title, and interests in and to the Service, including all proprietary technologies, software, methodologies, analytics, artificial intelligence, and machine learning occurring as a result of your use of the Service, and provided or made available to you by Epcy within, or in conjunction with, the Service, and any enhancements, derivative works, or improvements thereto. You acknowledge that the Service is protected by copyright, trademark, and other laws of the United Kingdom and other countries.

12.6 Feedback

If you provide to us with any ideas, suggestions, and/or proposals relating to the Service (or other products or services Epcy might develop) (all such communications to be referred to collectively as “Feedback”), you acknowledge and agree: (i) Feedback does not contain confidential or proprietary information; (ii) Epcy is not under any obligation of confidentiality, express or implied, with respect to any Feedback; (iii) Epcy shall be entitled to use or disclose (or choose not to use or disclose) such Feedback for any purpose, in any way; (iv) Epcy may already have under consideration or in development ideas similar to or the same as such Feedback; (v) your Feedback automatically becomes Epcy’ property without any obligation to you; and (vi) you are not entitled to any accounting, compensation, or reimbursement of any kind from Epcy under any circumstances on account of any Feedback. Epcy shall be entitled to utilize all Feedback in any way without restriction or obligation to you. Without limiting these rights, you hereby grant Epcy a perpetual, worldwide, sublicensable, non-exclusive, fully-paid, royalty free license under all of your intellectual property rights to use without compensation or acknowledgment to you or others, any Feedback provided to Epcy, including the rights to make and sell products and services based on such Feedback.

13. Reviews fetched from Google and TrustPilot

Epcy fetches Clinic’s reviews and ratings posted on Google and TrustPilot through DataforSEO.com in order to give Visitors a comprehensive and better review experience for their decision making process. All reviews fetched from Google and TrustPilot are outside of Epcy Limited’s terms and conditions outlined in here.

Reviews and ratings posted on Google and TrustPilot that are fetched to Epcy cannot be moderated by Epcy as the process is automatic.

Any review and rating posted on Google and TrustPilot that are deleted from these platforms may still be available on Epcy.

If you believe any review on Epcy fetched from Google or TrustPilot is outside of our terms and conditions, please contact us via info@epcy.com.

14. Other

If any part of these terms and conditions is held invalid, illegal, void or unenforceable, that part shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
